(New York, New York) (August 2, 2024)- WSHB New York is celebrating yet another win in a complex case involving New York’s contentious Labor Law. This win underscores the firm's strategic ability in setting up cases for success through powerful law in motion practice.
The case centered around a plaintiff's motion for Labor Law 240, stemming from an incident where the plaintiff fell 20 feet. In their moving papers, WSHB successfully established a genuine issue of fact regarding the alleged violation of the Labor Law 240. The firm’s detailed analysis and compelling arguments led to the dismissal of all Labor Law 200 and general negligence claims against the client, demonstrating that the client bore no actual negligence in the incident. The underlying matter was navigated by the team of senior associates Charlene Lanez and Matthew Lavoie.
“Proving the absence of negligence on our client's behalf was crucial in this case,” said Charlene Lanez, an associate in the New York office “We are pleased to see our thorough preparation and strategic approach yield such a favorable outcome.”
While the motion for indemnification was denied as premature, WSHB remains optimistic about the trial. The firm anticipates the client will secure indemnification if any negligence is found against another party. This outcome is particularly significant, as all active negligence claims against WSHB's client have been dismissed, safeguarding their interests going forward.
The case, pending in Bronx County, has the potential for a substantial verdict, amplifying the impact of this victory. The case was transferred to WSHB just before motions were due, and the swift, effective action by Lanez and Lavoie exemplifies the firm’s agility and expertise in high-stakes litigation.
“This victory reinforces our reputation as leaders in labor law and our dedication to defending our clients against unfounded claims,” said New York co-managing partner Jim Tyrie. “We look forward to further developments in this case and are committed to achieving the best possible outcomes for our clients.”
