The case arose from a violent incident where a resident of the apartment complex was attacked by another tenant and her son. The plaintiff contended that a security guard, employed by the defendant, was on an unauthorized break during the attack. The plaintiff alleged that had the guard been present, he could have witnessed and potentially intervened to avert the injuries sustained.
In response, the defense filed for summary judgment, asserting that the plaintiff failed to establish a direct causal link between the absence of the security guard and the injuries incurred. Under California law, the onus is on the plaintiff to demonstrate that the actions of the defendant were a significant factor in causing the alleged harm.
Kane successfully argued that the plaintiff did not meet this critical burden of proof, resulting in the court granting the motion for summary judgment in favor of our client.
