(Miami, Florida) (April 23, 2025)- In a significant win for WSHB, partner Ryan Schoeb, senior counsel Oliver Moll and associate Jonathan Garvin successfully obtained an order of dismissal in a high-exposure negligent security case stemming from a shooting at a commercial shopping center in Miami, Florida. The plaintiff, who was left paralyzed from the waist down after the incident, alleged that he was shot during a robbery gone wrong while on the property owned and managed by the client.
The lawsuit sought nearly $500,000 in medical damages alone and carried a potential exposure in the seven to eight- figure range. However, through strategic discovery and thorough investigation, WSHB was able to uncover critical facts that changed the trajectory of the case.

Contrary to the plaintiff's account, two independent eyewitnesses revealed that the plaintiff was involved in a drug deal at the time of the incident, classifying him as a trespasser under Florida law. These revelations came after the plaintiff denied the same under oath. Following the damaging deposition testimony, plaintiff's counsel filed a motion to withdraw from representation. Soon thereafter, WSHB filed a motion for summary judgment. Before the court could even rule on the motion, it issued an order dismissing the case in its entirety.
