The trial, held in Palm Beach County, Florida, culminated in a directed verdict, effectively dismissing the plaintiff's claim during jury proceedings.
The plaintiff alleged that a malfunctioning elevator at the clients’ property resulted in substantial injuries, leading to significant medical expenses and a seven-figure demand prior to trial. However, a thorough investigation and intense discovery uncovered critical inconsistencies in the plaintiff's account, particularly regarding his prior accident and injury history. Evidence revealed that the plaintiff had experienced multiple auto accidents and a subsequent incident, raising serious questions about the validity of his claimed injuries.
“This is a case where our trial team methodically tore apart every aspect of the plaintiff's case in chief, yet the plaintiff was recalcitrant and demanding a day in court,” said Schoeb, a trial attorney based in the Florida offices of WSHB. “Our evaluation did not change as the trial date approached, we stood firm and justice prevailed.”
