The managing partner of Wood Smith Henning & Berman's Seattle office, Tim Repass, has secured back-to-back success in yet another high-profile jury trial. Repass successfully defended a housing authority in an important slip and fall case in which an elderly tenant claimed $2.2 million in damages after a fall on an icy surface, but the jury awarded $396,000.
“This case falls in the category of matters which had to be resolved by the jury because of an inflexible demand from the plaintiff against our client,” said Repass. “We carefully evaluated all the evidence early in the litigation, and frankly, our evaluation is exactly where the jury verdict came in which vindicated our analysis.”
The plaintiff alleged that inadequate snow and ice management led to a wrist fracture, complex regional pain syndrome, and deformity that impaired hand function post-surgery. The WSHB defense team argued that the injuries did not fully align with the plaintiff's extensive claims. The jury found the plaintiff 25% at fault, underscoring the defense's successful argument and reducing the initial demand considerably.
"When the plaintiff is unwilling to listen to reason and is emboldened in this environment of large plaintiff verdicts and billboard advertising, it is important to send a message that juries are smart and not willing to write blank checks for unsubstantiated claims," Repass stated. The defense's strategy involved detailed expert medical testimony, clarifying the true extent of the plaintiff's injuries and illustrating discrepancies between her claims and actual limitations.
