The case involved a vehicle rented by a leading delivery company from our client, which resulted in an accident with the plaintiff. The plaintiff brought multiple claims against several insurance carriers, including PIP claims, negligence claims against the driver, and vicarious liability claims such as negligent supervision, negligent hiring/retention, owners' liability, and negligent entrustment against WSHB's client. Utilizing the Graves amendment, WSHB effectively argued that their client was not liable under the owners' liability statute. Additionally, they demonstrated that there could be no negligent entrustment due to the timing of the rental and the delivery driver's hiring.
The court granted WSHB's motion on all four counts with prejudice, a rare and decisive action in Michigan courts, which typically do not entertain motions for summary disposition before the close of discovery. This ruling is particularly significant, as it avoids the substantial defense costs often associated with prolonged litigation.
